USTR EXTENDS EXCLUSIONS SET

On December 16, 2022, the US Trade Representative (USTR) announced via a Federal Register Notice that it will extend Section 301 exclusions for 352 items previously set to expire on December 31, 2022.  Products previously excluded under HTS 9903.88.67 are now excluded through September 30, 2023.

Within the notice, the USTR advised the extension will allow time “to consider and align, as appropriate, the reinstated exclusions with the results of the statutory four-year review of the July 6, 2018 and August 23, 2018 actions, as modified”. A list of affected products is in the Federal Register Notice.

As discussed in our previous trade alert (USTR Section 301 Tariff Review), interested parties should consider providing formal comments to the USTR prior to the January 17 deadline.
