On Friday, August 21, 2020, United States Customs and Border Protection (CBP) issued a notice in Cargo System Messaging Service CSMS 43729326<\/a> to inform the trade that the 45-day transition period for compliance with the President\u2019s Executive Order (EO) 13936 on Hong Kong Normalization has been extended for an additional 45 days from September 25, 2020 to November 9, 2020. <\/p>\n

This additional 45 days will allow importers time to comply with the EO requirements for goods produced in Hong Kong to be appropriately marked with the origin of \u201cChina.\u201d\u00a0 During this transition period, CBP should not take any enforcement actions (i.e. marking notices, marking penalties, etc.) but should take measures to inform accounts and importers of these new marking rules for Hong Kong.<\/p>\n

As a reminder, this change in marking does not affect country of origin determinations for purposes of assessing ordinary duties under Chapter 1-97 of the Harmonized Tariff Schedule\u00a0(HTS) or temporary or additional duties under Chapter 99 of the HTS.\u00a0 Entry procedures have not changed as the change is only specific to 19 U.S.C. 1304 marking requirements.<\/p>\n
