En este art\u00edculo, revisaremos sus conceptos principales.<\/p>\n<p>&nbsp;<\/p>\n<h2>\u00bfQu\u00e9 es el fletamento mar\u00edtimo?<\/h2>\n<p>Como ya hemos se\u00f1alado, el fletamento mar\u00edtimo es el contrato para arrendar un barco para transportar mercanc\u00edas por mar.<\/p>\n<p>En este proceso est\u00e1n involucradas dos partes:<\/p>\n<ul>\n<li>El arrendador o fletador, que es el armador o la compa\u00f1\u00eda naviera que posee el barco.<\/li>\n<li>El arrendatario, que fleta el barco para transportar las mercanc\u00edas.<\/li>\n<\/ul>\n<p>El contrato de fletamento es el documento que pone por escrito los detalles de la operaci\u00f3n. Los detalles principales incluyen los datos fiscales de las dos partes, la ruta exacta, qui\u00e9n es el capit\u00e1n del barco, los tiempos de carga y descarga, etc.<\/p>\n<p>Existen tres tipos de contratos de fletamento: por viaje, a casco desnudo y por tiempo. Veamos cada uno en detalle.<\/p>\n<p>&nbsp;<\/p>\n<h3>Fletamento por viaje<\/h3>\n<p>En el fletamento por viaje, el arrendador pone a disposici\u00f3n un determinado espacio de carga en un buque para un viaje espec\u00edfico. Este es un tipo de fletamento muy com\u00fan en el transporte de carga a granel e implica:<\/p>\n<ul>\n<li>El armador transportando las mercanc\u00edas y gestionando el buque, que debe ser adecuado para la carga. El fletador tambi\u00e9n debe garantizar la entrega de la carga en el destino del viaje.<\/li>\n<li>El arrendatario transportando su propia carga o subcontratando el espacio a terceros.<\/li>\n<\/ul>\n<p>El conocimiento de embarque aparece en el contrato. Este documento es un recibo que especifica la colocaci\u00f3n de la carga, el nombre y registro del barco, su origen y destino, el tipo de mercanc\u00edas transportadas y su valor.<\/p>\n<p>&nbsp;<\/p>\n<h3>Fletamento a casco desnudo<\/h3>\n<p>Un fletamento a casco desnudo es un arrendamiento por un per\u00edodo de tiempo fijo, que implica:<\/p>\n<ul>\n<li>El arrendador recibiendo un pago regular por el alquiler, sin la responsabilidad de las mercanc\u00edas o transacciones del barco.<\/li>\n<li>El arrendatario teniendo el control total del buque, incluyendo el derecho a nombrar un capit\u00e1n y tripulaci\u00f3n. No puede subarrendarlo sin el permiso expreso del armador.<\/li>\n<\/ul>\n<p>El Barecon \/89 es el formulario est\u00e1ndar de fletamento de buques.<\/p>\n<p>&nbsp;<\/p>\n<h3>Fletamento por tiempo<\/h3>\n<p>El fletamento por tiempo es la forma m\u00e1s expedita de fletamento por tiempo para el transporte r\u00e1pido de mercanc\u00edas por mar:<\/p>\n<ul>\n<li>El fletador pone un buque a disposici\u00f3n del arrendatario por un per\u00edodo fijo. Esto es lo mismo que en el fletamento a casco desnudo. Sin embargo, en el caso del fletamento por tiempo, el fletador retiene la gesti\u00f3n del buque. Es responsable en \u00faltima instancia de que el capit\u00e1n y la tripulaci\u00f3n cumplan con las \u00f3rdenes comerciales del arrendatario.
