Aqu\u00ed entra en juego el fletamento mar\u00edtimo, que es el contrato de arrendamiento de un barco para mover mercanc\u00edas de un punto a otro.<\/p>\n<p>Para agilizar todo el proceso se ha establecido una f\u00f3rmula simplificada. Sin embargo, no est\u00e1 exenta de complejidad. En este art\u00edculo vamos a repasar sus conceptos principales.<\/p>\n<h2>Qu\u00e9 es el fletamento mar\u00edtimo<\/h2>\n<p>Como dec\u00edamos, el fletamento o flete mar\u00edtimo es el contrato de arrendamiento de un barco para transportar mercanc\u00edas por mar.<\/p>\n<p>En este proceso intervienen dos partes:<\/p>\n<ul>\n<li>El fletante, que es el armador o la empresa naviera propietaria del buque.<\/li>\n<li>El fletador, que alquila el buque para transportar su mercanc\u00eda.<\/li>\n<\/ul>\n<p>La p\u00f3liza de fletamento es el contrato que pone por escrito los detalles de la operaci\u00f3n. Los principales son los datos fiscales de las dos partes, cu\u00e1l es la ruta exactamente, qui\u00e9n es el capit\u00e1n de la nave, los tiempos de carga y descarga, etc.<\/p>\n<p>Existen tres tipos de contrato o p\u00f3liza de fletamento: por viaje, a casco desnudo y por tiempo. Vamos a verlos en detalle.<\/p>\n<h3>Fletamento por viaje<\/h3>\n<p>En el fletamento por viaje, tambi\u00e9n conocido como \u201cvoyage charter\u201d, el fletante pone a disposici\u00f3n del fletador un determinado espacio de carga de un buque para un viaje concreto. Esta es una modalidad muy com\u00fan en el transporte de mercanc\u00edas a granel. En ella:<\/p>\n<ul>\n<li>El fletante se compromete a transportar las mercanc\u00edas y a gestionar el buque, que debe ser apto para la carga. Tambi\u00e9n debe garantizar la entrega de la carga al t\u00e9rmino del viaje.<\/li>\n<li>El fletador puede transportar su propia carga o subcontratar ese espacio a terceros.<\/li>\n<\/ul>\n<p>Aparece en este contrato la figura de la gu\u00eda de carga o \u201cbill of lading\u201d. Este documento es un recibo en el que se especifica cu\u00e1l es la colocaci\u00f3n de la carga, el nombre y matr\u00edcula del buque, su origen y destino, la clase de mercanc\u00eda transportada y su valor.<\/p>\n<h2>Fletamento a casco desnudo<\/h2>\n<p>El fletamento a casco desnudo o \u201cbareboat charter\u201d es un arrendamiento por un tiempo determinado. En \u00e9l:<\/p>\n<ul>\n<li>El fletante recibe un pago regular en concepto de alquiler. Pero no tiene ninguna responsabilidad sobre las mercanc\u00edas o transacciones del buque.<\/li>\n<li>El fletador tiene el control total del buque, incluido el derecho a designar capit\u00e1n y tripulaci\u00f3n. No podr\u00e1 subarrendarlo sin el permiso expreso del armador.<\/li>\n<\/ul>\n<p>El formulario tipo Barecon \/89 es el modelo de contrato de arrendamiento de buque est\u00e1ndar.<\/p>\n<h3>Fletamento por tiempo<\/h3>\n<p>El fletamento por tiempo o \u201ctime charter\u201d es el m\u00e1s \u00e1gil para el transporte r\u00e1pido de mercanc\u00edas por mar:<\/p>\n<ul>\n<li>El fletante pone a disposici\u00f3n del fletador un buque por un plazo determinado. Esto es, igual que en el fletamento a casco desnudo. Sin embargo, en el caso del fletamento por tiempo el fletante retiene la gesti\u00f3n del buque. Es el responsable \u00faltimo de que el capit\u00e1n y la tripulaci\u00f3n cumplan las \u00f3rdenes comerciales del fletador. Debe responder de cualquier incumplimiento de los plazos acordados con el fletador o de cualquier da\u00f1o que sufra la carga bajo su responsabilidad.<\/li>\n<li>El fletador se encarga de la gesti\u00f3n comercial y asume los gastos de explotaci\u00f3n comercial. Debe devolver el buque seg\u00fan las condiciones pactadas y responder de cualquier da\u00f1o provocado por una carga inadecuada.<\/li>\n<\/ul>\n<h4>Conclusiones<\/h4>\n<p>En definitiva, el fletamento mar\u00edtimo es un contrato en el que hay que tomar en consideraci\u00f3n multitud de variables.
